 (a) Audit Committee Report to the Board of the Urban Renewal Agency of the City of Salem  
 
  Recommended Action:  The Audit Committee recommends that the Urban Renewal Agency Board accept the FY 2005-2006 audit of the Urban Renewal Agency of the City of Salem, Oregon.

* (b) Resolution No. 07-2 URA   Authorizing an Intrafund Loan from Fairview Industrial Park Urban Renewal Area to Mill Creek Industrial Park Urban Renewal Area - Ward 3 - Councilor Nanke - SEMCA    (UD)

  Recommended Action:  Staff recommends that the Urban Renewal Agency Board adopt Resolution No. 07-2 URA authorizing intrafund borrowing in the amount of $150,000 between the Fairview Industrial Park (FIP) Urban Renewal Area and Mill Creek Industrial Park (MCIP) Urban Renewal Area divisions of the Tax Allocation Improvement (TAI) Fund to finance conceptual and final design work related to water and sewer systems that will serve the Phase 1C and 1A areas in the MCIP.

2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES: Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.

   (a) Salem Social Service Contractor Presentation: Northwest Human Services Crisis Intervention Program    (CS)

    Recommended Action:  Information only.


   (b) Council Audit Committee Report to Council    

    Recommended Action: The Council Audit Committee recommends that City Council: 1) Accept the FY 2005-2006 CAFR and related Audit Management Letter, along with the staff responses; 2) Accept the Federal Grant Compliance Report; and 3) Accept the Willamette Valley Public Safety Communications Center audited Financial Statements.

 

     
3.   PUBLIC COMMENT: Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   4.2 RESOLUTIONS:

   (a) Resolution No. 2007-27  Dedicating property located at the southerly terminus of Elliot Street NW, Christopher Street NW and Cherry Blossom Drive NW within Brush College Heights No. 2, for right-of-way - Ward 8 - Councilor Clem - West Salem

    Recommended Action: Staff recommends that City Council adopt Resolution No. 2007-27.


   4.3 ROUTINE ITEMS:
           
   (a) Administrative Decision - Partition 07-5 - Ray Stombaugh - 2174 Hollywood Drive NE - Ward 1 - Councilor Walker - NOLA    (CD)

    Recommended Action: Information only.


   (b) Terminal Entrance - Ward 2 - Councilor Tesler - SEMCA    (CD)

    Recommended Action: Information only. 


   (c) McKay Area Coalition for Student Success - Wards 1, 5 and 6 - Councilors Walker, Stucky and Rogers - Lansing, NOLA, Northgate, ELNA and NESCA    (CS)

   (d) Request for sewer service outside city limits at 4982 Sunnyview Road NE - Ward 1 - Councilor Walker - NOLA   (PW)

    Recommended Action:  Staff recommends that City Council approve the connection to the City sewer system, conditioned upon the property owner submitting an approved annexation application and paying all usual and customary fees and service charges.

   (e) Purchase and Sale Agreement to acquire 1540 Glen Creek Road NW in West Salem for rebuilding of Fire Station #5 - Ward 8 - Councilor Clem - West Salem    (UD)

  Recommended Action: Staff recommends that City Council authorize the City Manager to execute a PSA to purchase the property located in West Salem at 1540 Glenn Creek Road  which will be used with adjoining parcels as a site for the construction of the new fire station #5.


 (f) Legislative Report     (Council Legislative Subcommittee)

  Recommended Action:  It is recommended that City Council adopt the positions recommended by the Legislative Subcommittee.
 

5.   SPECIAL ORDERS OF BUSINESS:   (Includes consideration of items deferred from the consent calendar and any action item which requires a selection among options, or consideration of matters of special importance to the Council)

   (a) Continued Deliberations: Adoption of the City’s Fiscal Year 2007-08 through 2011-12 Capital Improvement Program    (AS)
 
    Recommended Action:  Staff recommends that City Council adopt the Preliminary CIP, as published, with the changes listed in Table I (Attachment A of the staff report).

    Note: Public hearing was held on March 12, 2007.

   (b) Review of Hearings Officer decision of Variance Case No. 06-13 for property located at 1770 Baxter Road SE - Ward 4 - Councilor Sullivan - South Gateway   (CD)

    Recommended Action:  Staff recommends that City Council affirm the February 13, 2007, decision of the Hearings Officer to deny the request to allow a ten (10) foot tall, forty (40) square-foot, internally illuminated, freestanding sign where a five (5) foot tall, twenty-four (24) square-foot, non-illuminated sign is allowed in a RA (Residential Agriculture) zone located at 1770 Baxter Road SE for Our Savior's Lutheran Church (Attachment A of the staff report). Findings and Order issued by the Hearings Officer on February 13, 2007, is presented in Attachment C of the staff report.

8.   CALENDAR OF ORDINANCE BILLS:

   8.1 FIRST READING OF ORDINANCE BILLS

   (a) Ordinance No. 83-07  Relating to Amendments to the Wastewater Management Master Plan; and Amending SRC 64.230    (PW)

    Recommended Action:  Staff recommends that City Council advance Ordinance No. 83-07 to second reading for enactment.


   (b) Ordinance No. 84-07  Relating to Uses and Minimum Lot Area Restrictions in the Industrial Business Complex (IBC) Zone; Amending SRC 156.020, SRC 156.040, and SRC 156.090    (CD)

    Recommended Action:  Staff recommends that City Council advance Ordinance No. 83-07 to second reading for enactment.  Enactment of Ordinance Bill No. 84-07 will amend SRC Chapter 156, Industrial Business Campus (IBC), to allow commercial research and development laboratories as a permitted use and remove the minimum lot area restriction, which limits the total area of lots less than 20 acres to not more than 30 percent of a discrete IBC-zoned district, and make other amendments for consistency.


   (c) Ordinance No. 85-07  Relating to Amendments to the Salem Transportation System Plan; amending SRC 64.230    (PW)

    Recommended Action:  Staff recommends that City Council hold a public hearing on Ordinance No. 85-07 and advance it to second reading for enactment.  Enactment of Ordinance No. 85-07 would amend SRC Chapter 64.230(i), Salem Transportation System Plan. 
   
  8.2 SECOND READING OF ORDINANCE BILLS
   
   (a) Ordinance No. 74-07 Relating to the use of the streets and public ways of the City of Salem; amending SRC 95.730, SRC 95.740, SRC 95.750, SRC 95.760, SRC 95.770, SRC 102.050, SRC 102.535, and SRC 102.675; and creating new provisions - Wards 1 and 5 - Councilors Walker and Stucky - CAN-DO, Grant, Highland and Northgate    (PD)
