B. PUBLIC COMMENT:  (Comment on specific agenda items other than public hearings and deliberations.  Each person’s comments will be limited to three minutes.)


C. ACTION ITEMS:

     *     (1) Resolution No. 07-3 URA  Granting Exceptions to Certain Provisions of the Pringle Creek Urban Renewal Plan in the Disposition and Redevelopment of Property at 633 Ferry Street SE - Ward 2 - Commissioner Tesler - CAN-DO  (UD)    
 
  Recommended Action: Staff recommends the Urban Renewal Agency Board adopt Resolution 07-3 URA to grant exceptions to Section 500 A through C and Section 700 A through H of the Pringle Creek Urban Renewal Plan for the Agency-owned property at 633 Ferry Street SE. 


     *     (2) Resolution No. 07-4 URA  Initiating the Amendment Process to Decrease the Boundary of the Pringle Creek Urban Renewal Area - Ward 2 - Commissioner Tesler - CAN-DO
 
  Recommended Action: Staff recommends the Urban Renewal Agency Board: 1) adopt Resolution No. 07-4 URA initiating a major amendment to the Pringle Creek Urban Renewal Plan to decrease the area of the Pringle Creek Urban Renewal Area; and 2) rescind Resolution No. 06-26 URA initiating a minor amendment to the Pringle Creek Urban Renewal Plan.


     *     (3) Purchase and Sale Agreement for sale of vacant parcel at 633 Ferry Street SE - Ward 2 - Commissioner Tesler - CAN-DO    (UD)

  Recommended Action: Staff recommends the Urban Renewal Agency Board approve the sale of a vacant Agency-owned parcel at 633 Ferry Street SE in the Pringle Urban Renewal Area to Willamette University for redevelopment and authorize the executive director to execute the purchase and sale agreement (PSA) attached to the staff report.


     * (4) North Gateway Spending Plan Amendments to fund Senior Center Construction - Ward 5 - Commissioner Stucky - Highland    (UD)  
 
  Recommended Action: Staff recommends the Urban Renewal Agency Board reallocate $3,500,000 of funds currently designated for Salem Industrial Drive, allocating up to $2,500,000 to support the Hollywood Station Redevelopment project and setting aside the remaining $1,000,000 as “unspecified” - to be allocated at a later date.


     * (5) Financing the Chemeketa and Liberty Panel Replacement Project - Ward 2 - Commissioner Tesler - CAN-DO    (AS)

  Recommended Action: Staff recommends the Urban Renewal Agency Board approve the commitment of funds identified for parking structure projects in the Riverfront/Downtown 10-Year Spending Plan to the repayment of a $1.1 million loan, the proceeds of which would be used to complete the replacement of concrete panels on Chemeketa and Liberty parking structures.


     * (6) Reappointments/Appointments to various Urban Renewal Agency Advisory Boards

  Recommended Action: The Agency Appointments Committee recommends reappointment/appointment of the candidates listed in the Facts and Findings section of the report.

2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES: Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.     

   (a) Salem Senior Center Advisory Commission Annual Report     (CS)

    Recommended Action: Information only.


   (b) Salem Social Service Contractor Presentation : Northwest Human Services HOST Program    (CS)

    Recommended Action: Information only.


   (c) Appointments/Reappointments to various Advisory Boards and Commissions

    Recommended Action: The Council Boards and Commissions Appointments Committee recommends that City Council appoint/reappoint the candidates listed in the Facts and Findings section of the report.
    

3.   PUBLIC COMMENT: Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.

   4.2 RESOLUTIONS:

    (a) Resolution No. 2007-37   Dedicating property located at the northerly terminus of Harlandale Avenue within Harlandale Estates for street and right-of-way - Ward 4 - Councilor Sullivan - South Gateway    (PW)

    Recommended Action: Staff recommends that City Council adopt Resolution No. 2007-37.


    (b) Resolution No. 2007-38  Dedicating property located at the westerly terminus of Muirfield Avenue within Phase 10 of Golf Club Estates @ Creekside for street and right-of-way - Ward 4 - Councilor Sullivan - South Gateway    (PW)

    Recommended Action: Staff recommends that City Council adopt Resolution No. 2007-38.


   4.3 ROUTINE ITEMS:

    Recommended Action: Information only. 


   (b) Approve support of new downtown organization by Mid-Willamette Valley Council of Governments - Ward 2 - Councilor Tesler - CAN-DO    (AS)

    Recommended Action: Staff recommends that City Council approve the motion of the Downtown Strategy Steering Committee to utilize any remaining resources in the Intergovernmental Agreement with Mid-Willamette Valley Council of Governments to provide support to the new non-profit downtown organization.


     *  (c) Administrative Decision - Partition No. 07-6 - Brent and Janet Sanders - 1095 Hoffman Rd NE - Ward 6 - Councilor Rogers - ELNA    (CD)

    Recommended Action: Receive and File.

   (g) American Planning Association Case Study     (CD, CS, PW)

    Recommended Action: Information only. 


   (h) Remand/Wallace Hills Estates - Ward 8 - Councilor Clem - West Salem       (Legal and CD)

    Recommended Action:  Staff recommends that the City Council: 1) limit the scope of proceedings to the issue remanded by LUBA, and; 2) do not conduct an additional hearing; or 3) if a hearing is held, Council hold the hearing itself.


*  (i) Approval of the Oregon Public Electronic Network (OPEN) program wind-down plan for FY 2007-08    (Library)

    Recommended Action: Staff recommends that City Council approve the wind-down of the OPEN dial-up Internet service program over the course of the 2007-08 fiscal year, and set June 30, 2008 as the termination date for the program.


    (j) Salem Police Department Facility Study Status Report     (PD)
  
    Recommended Action: Information only.
   

 *  (k) Amended Intergovernmental Agreement with the City of Turner for wholesale water service    (PW)

    Recommended Action: Staff recommends that City Council authorize the City Manager to execute an amended Intergovernmental Agreement with the City of Turner.


    (l) Quitclaim a 10-foot-wide water easement previously required for construction of a 16-inch water main to the Skyline Water Reservoir, 2365 Davis Road S - Ward 7 - Councilor DeHart - Sunnyslope    (PW)

    Recommended Action: Staff recommends that City Council authorize staff to execute a quitclaim deed for the easement area to the underlying owner as shown in the legal description (Attachment A of the staff report) and the easement map (Attachment B of the staff report).


   (m) Salem Senior Center, request a third amendment to Purchase and Sale Agreement and authorize a shared parking agreement - Ward 5 - Councilor Stucky - Highland    (UD)

Recommended Action: Staff recommends that City Council: 1) approve a third amendment to the Purchase and Sale Agreement (PSA) for the surplus sale of the Salem Senior Center at 1055 Erixon Street NE Salem, OR and authorize the City Manager to execute the amendment; and 2) authorize a shared parking agreement with the Salem Clinic for the use of 40 parking spaces at the Salem Senior Center, and authorize the City Manager to execute the shared parking agreement.


*  (n) Legislative Report      (CM)

    Recommended Action:  It is recommended that City Council: 1) consider and approve official legislative positions, with assistance from recommendations from two members of the Legislative Subcommittee; and, 2) consider and approve an opinion in support of funding for higher education in Oregon.  


   (o) Letter from City of Keizer regarding Sewer Surcharge     (CM)

    Recommended Action: It is recommended that City Council refer the letter to the Water/Wastewater Task Force and to staff for their recommendations on this issue.

   (a) Continuation of Council Review of Planning Commission Decision - Comprehensive Plan Change / Zone Change No. 06-6 - Pacific Realty Associates, L.P. - 2500 Block of Boone Rd SE - Ward 4 - Councilor Sullivan - South Gateway    (CD)  
    
    Note: This public hearing was continued from May 7, 2007 in order to allow time for the City Council to ask questions of staff.  No further public testimony will be taken. The record will remain open until May 21, 2007.


   (b) Petition-initiated vacation of unopened Bluff Avenue SE right-of-way, between Cannon Street SE and McGilchrist Street SE right-of-way - Ward 2 - Councilor Tesler - SCAN    (PW)

    Recommended Action:  Staff recommends that City Council approve the petition-initiated vacation of unopened Bluff Avenue SE right-of-way, between Cannon Street SE and McGilchrist Street SE right-of-way, subject to the conditions to reserve an access easement and a public utility easement for maintenance of existing utilities, and for petitioners to pay an assessment of special benefit.


8.   CALENDAR OF ORDINANCE BILLS:

   8.1 FIRST READING OF ORDINANCE BILLS

   (a) Ordinance No. 90-07 Revising Two Assessments Established by Ordinance Bill No. 86-07; and declaring an emergency - Wards 4 and 8 - Councilors Sullivan and Clem - South Gateway and West Salem    (PW)    

    Recommended Action:  Staff recommends that City Council advance Ordinance Bill No. 90-07 to second reading and enactment, to correct scrivener's errors in Ordinance Bill No. 86-07.


   (b) Ordinance No. 91-07   Providing Financing to Property Owners for Payment of Parks, Water, Sewer, and Transportation System Development Charges Against Property Located in Salem, Oregon; making provisions therefor; and declaring an emergency - Wards 4 and 8 - Councilors Sullivan and Clem - South Gateway and West Salem    (PW)

    Recommended Action:  Staff recommends that City Council advance Ordinance Bill No. 91-07 to second reading and enactment, establishing a lien on the property listed.
