  1.1 Pledge of Allegiance


2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES:  Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.  
    
   
3.   PUBLIC COMMENT:  Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.

 4.2 RESOLUTIONS:

 *  (a) Resolution No. 2007-82  Appointing City of Salem Councilors Chuck Bennett and Kate Tarter to the Board of Commissioners of the Housing Authority of the City of Salem   (CS)

    Recommended Action:  Staff recommends that City Council approve Resolution No. 2007- 82 appointing Chuck Bennett and Kate Tarter to the Housing Authority Board of Commissioners.


 *  (b) Resolution No. 2007-83  Authorizing the City Manager to Execute a Grant Agreement with the Federal Aviation Administration for Capital Improvements at McNary Field - Ward 2 - Councilor Tesler - SEMCA    (CD)

    Recommended Action:  Staff recommends that City Council approve Resolution No. 2007-83 authorizing the City Manager to execute an FAA grant offer for security lighting, security fencing and engineering design of new taxilanes.

  
   (c) Resolution No. 2007-84  Authorizing Negotiation for the Acquisition of  Permanent Easements for Installation of a Sanitary Sewer Service Connection     (PW)

    Recommended Action:  Staff recommends that City Council approve Resolution No. 2007-84 declaring intent to negotiate for the acquisition of easements for the installation of a sanitary sewer service connection.


   4.3 ROUTINE ITEMS:        
   
 (a) Reappointment of Municipal Judge Pro Tempore    (AS)

    Recommended Action:  Judge Aiken requests that Municipal Judge Pro Tempore, Noel Grefenson, be reappointed by City Council to serve another term in this position.


   (b) Appointment of Municipal Judge Pro Tempore    (AS)

    Recommended Action:  Judge Aiken requests that City Council appoint Lindsay Partridge as Municipal Judge Pro Tempore effective August 27, 2007.

   (c) Administrative Decision - Replat 07-8 - SAGE-SG, Inc. and Anderson Homes, LLC - 4651 Desiree Court SE, 4670 Southhampton Drive SE and 4680 Southhampton Drive SE - Ward 3 - Councilor Nanke - Morningside    (CD)

    Recommended Action:  Receive and File.


   (d) Hearings Officer Decision - Variance Case No.07-7 - Lawrence Homes, LLC - 1810 Rees Hill Road SE - Ward 4 - Councilor Sullivan - South Gateway    (CD)

    Recommended Action:  Receive and File.


   (e) Subdivision Review Committee Decision - Partition 07-20 - Northwest Willamette Home LLC - 2247 Evergreen Avenue NE - Ward 1 - Councilor Bennett - Lansing    (CD)

    Recommended Action:  Receive and File.

         (g) Amendment to Emergency Water Agreement    (PW)

    Recommended Action:  Staff recommends that City Council approve the Amendment to Emergency Water Agreement, Attachment A of the staff report.


   (h) Quitclaim three abandoned Water Transmission Conduit Easements in the City of Turner    (UD)

    Recommended Action:  Staff recommends that City Council authorize the City Manager to execute a quitclaim deed (Attachment A of the staff report) releasing all rights, title, and interest in three abandoned water transmission conduit easements located adjacent to Franzen Reservoir in the City of Turner.


5.   SPECIAL ORDERS OF BUSINESS:   (Includes consideration of items deferred from the consent calendar and any action item which requires a selection among options, or consideration of matters of special importance to the Council)

7.   PUBLIC HEARINGS:  (Includes deliberations and deliberations from hearings held over from previous meetings). Public hearings will commence no later than 7:30 p.m.
     
   (a) Sidewalk Repair Program and Revisions to Salem Revised Code Chapter 78, Sidewalks    (PW)

    Recommended Action:  Staff recommends that the City Council advance Ordinance Bill No. 99-07 to second reading for enactment. Ordinance Bill No. 99-07 amends SRC Chapter 78, Sidewalks, making technical changes, assigning responsibility for sidewalk repairs, requiring disclosure of sidewalk defects, and specifying procedures for enforcement actions. Staff further recommends that Council approve the following components of a Sidewalk Repair Program:          1)  Creation of a Sidewalk Repair Loan Assistance Program to be funded up to $100,000 per year out of the $1 million in Qwest Reserve Funds set aside for sidewalk improvements, with the procedures and loan eligibility criteria as set forth in Attachment A of the staff report.  2)  Implementation of a City Sidewalk Repair Program for sidewalks damaged by City street trees to be funded up to $150,000 per year out of the $1 million in Qwest Reserve Funds set aside for sidewalk improvements.  This is in addition to the extra $57,000 approved by the Budget Committee to be used for repairing tree-damaged sidewalks in the FY2007/2008 budget (total budget: $250,000).  Staff will return to Council with an action plan containing criteria for prioritizing repair of tree-damaged sidewalks.  3) Continuation of the City’s grind and patch program for minor sidewalk repairs as funded by the Council on an annual basis. 4) Exploration of the use of future federal Community Development Block Grant funds to address sidewalk repairs in neighborhoods that meet the eligibility requirements for the use of those funds. 5) Inclusion of properties located within the Downtown Urban Renewal District boundaries subject to property owner repair responsibility and disclosure requirements. (Note: This differs from the Task Force recommendation)

  (b) South Waterfront Urban Renewal Area - Ward 2 - Councilor Tesler - CAN-DO and SCAN    (UD)   

    Recommended Action:  Staff recommends that City Council hold a public hearing on August 27, 2007 regarding Ordinance No.106-07 to consider adoption of the South Waterfront Urban Renewal Plan and after such hearing, determine whether to advance Ordinance No. 106-07 to second reading.

8.   CALENDAR OF ORDINANCE BILLS:

   8.1 FIRST READING OF ORDINANCE BILLS
 
   (a) Ordinance No. 105-07  Providing for the Reimbursement for the Extension of the Municipal Sewer System, Declaring the Costs Thereof, and Apportioning the Cost of Construction to Properties Benefitted Therefrom - Ward 8 - Councilor Clem - West Salem    (PW )

    Recommended Action:  Staff recommends that City Council advance Ordinance No. 105-07 to second reading for enactment, establishing reimbursement for the extension of the municipal sewer system, declare the costs thereof, and apportion the cost of construction to properties benefitted therefrom.


   (b) Ordinance No. 106-07  Approving the South Waterfront Urban Renewal Plan and Making Determinations and Findings in Reference Thereto - Ward 2 - Councilor Tesler - CAN-DO and SCAN    (UD)

    Recommended Action:  Staff recommends that City Council advance Ordinance No. 106-07 to second reading.


  (c) Ordinance No. 110-07  Relating to Urban Growth Management, creating new provisions and amending SRC 63.052    (PW)
 
    Recommended Action:  Staff recommends that City Council advance Ordinance No. 110-07 to second reading for enactment, which will establish a fee-in-lieu of construction for certain conditions of development.

  (d) Ordinance No. 111-07  Relating to Civil Exclusion; amending SRC 95.740 and SRC 95.770; and declaring an emergency - Wards 1 and 5 - Councilors Bennett and Tarter - Grant, Highland and Northgate

    Recommended Action:  Staff recommends that City Council advance Ordinance No. 111-07 to second reading for enactment.


   8.2 SECOND READING OF ORDINANCE BILLS

   (a) Ordinance No. 103-07  Vacating a three-foot strip of right-of-way along the north side of Belmont Street NE, between Broadway Street NE and the alley east of Liberty Street NE - Ward 2 - Councilor Tesler - CAN-DO    (PW)
    

   (b) Ordinance No. 104-07  Vacating an eighteen-foot strip of right-of-way along the north side of Glen Creek Road NW, west of Wallace Marine Park - Ward 8 - Councilor Clem - West Salem    (PW)
