  Recommended Action:  Staff recommends that the Commission adopt Resolution No. 2036 authorizing a contract for legal services with the City of Salem.


 3.2 Resolution No. 2037 Authorizing Payment of Labor Relations Support and Execution of a Payroll Services Contract with the City of Salem   

  Recommended Action:  Staff recommends that the Commission adopt Resolution No. 2037 authorizing payment of labor relations expense and execution of a contract for payroll services with the City of Salem.

2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES:  Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.  
   
   (a) Salem Human Rights and Relations Advisory Commission 2007-08 Work Plan and Annual Report    (CS)

    Recommended Action:  Staff recommends that City Council approve the    2007-08 Work Plan for the Human Rights and Relations Advisory Commission.

   
3.   PUBLIC COMMENT:  Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.  

All agenda items marked by  *  require action by Council at this meeting meeting.

4.   CONSENT CALENDAR:  All items on the Consent Calendar that will be adopted as a group by a single motion.

   4.1 MINUTES:

   (a) August 20, 2007

   4.2 RESOLUTIONS:

     *   (a) Resolution No. 2007-77 Setting Fees and Charges for the Building & Safety Area (CD)

    Recommended Action: Staff recommends that City Council approve Resolution No. 2007-77 adding new fees to the Building and Safety fee schedule for processing sign applications for adjustments and appeals with an effective date of September 6, 2007.


   4.3 ROUTINE ITEMS:       
   
         (a) Hearings Officer Decision - Conditional Use Case No. 07-6 - Steven Black, B&B Property Development LLC - 1925-1941 Lancaster Drive NE - Ward 6 - Councilor Rogers - NESCA    (CD)

    Recommended Action:  Receive and File.


         (b) UGA Development Review Committee Decision - Preliminary Declaration for Urban Growth Area Development Permit No. 07-6 - Hong Properties LLC - 2600 Block of Landau Street SE - Ward 4 - Councilor Sullivan - South Gateway    (CD)

    Recommended Action:  Receive and File.  


          (c) Planning Commission Annual Review of the Neighborhood Organization Status for the South Central Association of Neighbors (SCAN) - Ward 2 - Councilor Tesler    (CD)

    Recommended Action:  The Planning Commission recommends continued recognition Neighborhood Organization Status for the South Central Association of Neighbors (SCAN) as an official neighborhood organization.


     *    (d) Application, Notification of Award, and Grant Compliance Agreement for a $10,000 Fireman’s Fund Heritage Award Grant    (FD)

    Recommended Action:  Staff recommends that City Council authorize the Fire Department to submit a formal grant application and authorize the City Manager to sign a Grant Compliance Agreement enabling the Fire Department to receive a $10,000 Fireman’s Fund Heritage Award Grant for the purpose of purchasing a thermal imaging camera. There is no matching requirement for this grant.

        (e) Waterways Map Update    (PW)
  
    Recommended Action:  Information only.


         (f) South Waterfront Urban Renewal Area Plan Adoption - Ward 2 - Councilor Tesler - CAN-DO and SCAN    (Legal)
  
    Recommended Action:  Information only. 


     *   (g) Updated Information concerning the approval of the South Waterfront Urban Renewal Area Plan - Ward 2 - Councilor Tesler - CAN-DO and SCAN    (UD)
  
    Recommended Action: Staff recommends that City Council enact Ordinance No. 106-07, approving the South Waterfront Urban Renewal Area Plan as currently proposed.

   (a) Proposed Amendment to Transportation System Development Charge Methodology    (PW)

    Recommended Action: Staff recommends that City Council adopt Resolution No. 2007-86 adopting the proposed change to the City’s Transportation System Development Charge methodology.
  
   (b) Annexation (Health Hazard) of Territory Located at 3887 Homestead Road S - Annexation Case No. C-653 - Ward 7 - Councilor DeHart - Croisan-Illahe    (CD)

    Recommended Action:  Staff recommends that City Council: 1) Find that the Petitioners have signed a valid triple majority petition (Attachment B of the staff report) for annexation of the Territory; 2) Determine that Annexation Case No.  C-653 is exempt from the public vote requirement due to the existence of a health hazard (failed water system), pursuant to Section 61of the Salem City Charter and SRC 165.050; 3) Determine that Annexation Case No. C-653 satisfies the criteria of SRC 165.130(c) and adopt Order No. 07-C-653 (Attachment L of the staff report); 4) Re-zone the Territory from the Marion County UT-5 (Urban Transitional) zone to the City of Salem RA (Residential Agriculture) zone; and   5) Withdraw the Territory from the Salem Suburban Rural Fire Protection District.


   (c) Annexation (Health Hazard) of Territory Located at 3831 Homestead Road S - Annexation Case No. C-658  - Ward 7 - Councilor DeHart - Croisan-Illahe    (CD)

    Recommended Action:  Staff recommends that City Council: 1) Find that  the Petitioners have signed a valid triple majority petition (Attachment B of the staff report) for annexation of the Territory; 2) Determine that Annexation Case No.  C-658 is exempt from the public vote requirement due to the existence of a health hazard (failed water system), pursuant to Section 61of the Salem City Charter and SRC 165.050; 3) Determine that Annexation Case No. C-658 satisfies the criteria of SRC 165.130(c) and adopt Order No. 07-C-658 (Attachment L of the staff report); 4) Re-zone the Territory from Marion County UT-5 (Urban Transitional) zone to City of Salem RA (Residential Agriculture) zone; and 5)Withdraw the Territory from the Salem Suburban Rural Fire Protection District.

   (d) Annexation (Health Hazard) of Territory Located at 2230 Doaks Ferry Road NW - Annexation Case No. C-655  - Ward 8 - Councilor Clem - West Salem    (CD)

    Recommended Action:  Staff recommends that City Council: 1) Find that the Petitioners have signed a valid triple majority petition (Attachment B of the staff report) for annexation of the Territory; 2) Determine that Annexation Case No.  C-655 is exempt from the public vote requirement due to the existence of a health hazard (failed water system), pursuant to Section 61of the Salem City Charter and SRC 165.050; 3) Determine that Annexation Case No. C-655 satisfies the criteria of SRC 165.130(c) and adopt Order No. 07-C-655 (Attachment K of the staff report); 4) Re-zone the Territory from the Polk County SR (Suburban Residential) zone designation to the City of Salem RA (Residential Agriculture) zone designation; and 5) Withdraw the territory from the Salem Suburban Rural Fire Protection District.


8.   CALENDAR OF ORDINANCE BILLS:

   8.1 FIRST READING OF ORDINANCE BILLS

   (a) Ordinance No. 102-07  Relating to Fire Prevention; amending SRC 41.150, SRC 58.001, SRC 58.003, SRC 58.004, and SRC 58.190; and creating new provisions

    Recommended Action:  Staff recommends that City Council advance Ordinance No. 102-07 to second reading for enactment without holding a public hearing to adopt the most current Oregon Fire Code adopted by the State of Oregon, adopt an optional section of the Oregon Residential Specialty Code Requiring for sprinkler systems in some multi-family dwellings, and modify water system development charges to encourage fire sprinkler installation.
