C. PUBLIC COMMENT:   (Comment on specific agenda items other than public hearings and deliberations.  Each person’s comments will be limited to three minutes.)

D. ACTION ITEMS:

     *  (1)  Resolution No. 07-11 URA  Initiating the Amendment Process to Remove the Time Limit for Bond Issuance in the North Gateway Urban Renewal Plan - Ward 5 - Councilor Tarter - Northgate    (UD)

  Recommended Action:  Staff recommends that the Urban Renewal Agency (Agency) declare the proposed amendment a minor amendment and adopt Resolution No. 07-11 URA to remove references to the time limit for bond issuance in the North Gateway Urban Renewal Plan.  (As authorized by Ballot Measure 50 and Ordinance 48-98 the Plan’s term is governed by maximum indebtedness rather than a specific termination date)

    * (2)  Resolution No. 07-12 URA Initiating the Amendment Process to Correct a Scrivener’s Error and Further Define the Park Project in the North Gateway Urban Renewal Plan - Ward 5 - Councilor Tarter - Northgate     (UD)

  Recommended Action:  Staff recommends that the Urban Renewal Agency (Agency) declare the proposed amendment a minor amendment and adopt Resolution No. 07-12 URA to define the scope of the Community Nature Park project and correct a scrivener’s error in the North Gateway Urban Renewal Plan (Plan).

2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES:  Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.  
   
   (a) Annual Planning Commission Report to the City Council 

   
3.   PUBLIC COMMENT:  Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.

   4.2 RESOLUTIONS:

   (a)  Resolution No. 2007-87  Dedicating property located at the north line of Wiltsey Road SE, west of Commercial Street SE, for street and right-of-way - Ward 4 - Councilor Sullivan - South Gateway (PW)

    Recommended Action:  Staff recommends that City Council approve Resolution No. 2007-87.

   (b) Resolution No. 2007-88  Dedicating property located east of Doaks Ferry Road NW, north line of Eola Drive NW, for street and right-of-way - Ward 8 - Councilor Clem - West Salem    (PW)

    Recommended Action:  Staff recommends that City Council approve Resolution No. 2007-88.

   (c) Resolution No. 2007-89  Authorizing the City Manager to Execute an Intergovernmental Agreement to Dispense Vaccines, Antibiotics, and Other Medications in a Pandemic Influenza or Other Public Health Emergency    (FD)

    Recommended Action: Staff recommends that City Council approve Resolution No. 2007-89 authorizing the City Manager to: 1) execute an IGA with MCHD to establish SFD as a closed POD site for the administration of vaccines, antibiotics or other medications, with MCHD responsible for the cost of medications, and    2) execute letters of agreement with MCHD in the future to coordinate responses to particular public health emergencies as they arise.

   4.3 ROUTINE ITEMS:

    Recommended Action: Information only.

         (b) Hearings Officer Decision - Variance Case No. 07-6 - Anton Chernishoff; Steve Kay - 1090 Shipping Street NE - Ward 1 - Councilor Bennett - Grant    (CD)

    Recommended Action: Receive and File.  

         (c) Historic Landmarks & Design Review Commission Decision - Design Review Case No. DR07-7 - Cliff Friesen and Terry Robertson - 525 Wallace Road NW and 570 Bassett Street NW - Ward  8 - Councilor Clem - West Salem    (CD)

    Recommended Action: Receive and File. 

         (d) Historic Landmarks & Design Review Commission Decision - Design Review Case No. DR07-8 - Beverlee Hughes, Salem Keizer Community Development Corp. - 100-200 Blocks of 25th Street NE - Ward 6 - Councilor Rogers - NEN    (CD)

    Recommended Action:  Receive and File.

 *  (e) Order No. 2007-10-HDR application Historic Design Review Case No. 07-3 - In the matter of affirming the decision of the Historic Landmarks and Design Review Case No. 07-3 for property located at 985 High Street SE, Salem, OR - Ward 2 - Councilor Tesler - SCAN   (CD)

    Recommended Action:  Staff recommends that City Council adopt Order No. 2007-10-HDR.

    Note: Public hearing was held on August 13, 2007. 

   (f) Purchase and Sale Agreement to acquire a 0.57 acre parcel of land to expand the City’s Shop Complex - Ward 2 - Councilor Tesler - SESNA    (UD)

    Recommended Action:  Staff recommends that City Council authorize the City Manager to execute a Purchase and Sale Agreement (PSA) to purchase a 0.57 acre parcel located adjacent to the City owned parcel at 2275 Oxford Street in Southeast Salem for expansion of the City’s shop complex.

7.   PUBLIC HEARINGS:  (Includes deliberations and deliberations from hearings held over from previous meetings). Public hearings will commence no later than 7:30 p.m.
     
   (a) Council Review of Planning Commission Decision on Comprehensive Plan Change/Zone Change 07-3 for property located at 5800 Commercial Street SE and 1821 Wiltsey Road SE - Ward 4 - Councilor Sullivan - South Gateway   (CD)

    Recommended Action:  Staff recommends that City Council affirm the decision of the Planning Commission to approve, with conditions, the request to change the Salem Area Comprehensive Plan Map designation from "Multi-Family Residential" to "Commercial" and to change the zoning from RM2 (Multiple Family Residential) to CR (Retail Commercial) for a 5.84 acre site located at 5800 Commercial Street SE and 1821 Wiltsey Road SE (Marion County Assessor's Map Number: T08S R3W S14 Quarter Section CD, Tax Lots 200 and 2800). The decision and conditions of approval are as required in the Planning Commission Resolution 07-6 issued July 17, 2007 (Attachment B of the staff report).

 (b) Continuation: Annexation (Health Hazard) of Territory Located at 3831 Homestead Road S - Annexation Case No. C-658  - Ward 7 - Councilor DeHart - Croisan-Illahe    (CD)

    Recommended Action:  Staff recommends that City Council extend the continuation of the City Council hearing of Annexation Case C-658 to September 24, 2007, in order to provide additional time for staff to respond to City Council information requests.

     
8.   CALENDAR OF ORDINANCE BILLS:

   8.1 FIRST READING OF ORDINANCE BILLS

   (a) Ordinance No. 102-07  Relating to Fire Prevention; amending SRC 41.150, SRC 58.001, SRC 58.003, SRC 58.004, and SRC 58.190; and creating new provisions

    Recommended Action:  Staff recommends that City Council advance Ordinance No. 102-07 to second reading for enactment.


   (b) Ordinance No. 113-07  Providing financing to property owners for payment of parks, water, sewer, and transportation system development charges against property located in the City of Salem, Oregon; making provisions therefor; and declaring an emergency - Wards 1, 4, 7 and 8 - Councilors Bennett, Sullivan, DeHart and Clem - Lansing, South Gateway, Croisan-Illahe and West Salem (PW)

    Recommended Action:  Staff recommends that City Council advance Ordinance No. 113-07 to second reading for enactment, establishing a lien on the property listed.
