      (a)  Fiscal Year 2008-09 Urban Renewal Agency Budget Calendar     (CM)

             Recommended Action:  Staff recommends that the Urban Renewal Agency Board approve the FY 2008-09 budget calendar.


   * (b)  Resolution No. 07-17 URA Amending Section 2 of Resolution No. 07-6 URA which Adopted the Budget of the Urban Renewal Agency of the City of Salem, Oregon for Fiscal Year 2007-08, Made Appropriations,  and Imposed and Categorized Taxes - Ward 2 - Councilor Tesler - CAN-DO     (CM)

           Recommended Action:  Staff recommends that the Urban Renewal Agency Board approve Resolution No. 07-17 URA amending the FY 2007-08 Urban Renewal Agency budget resolution. 

  * (c)  Second Amendment to the Disposition and Development Agreement for the 295 Church Street SE Redevelopment Project     (UD)

           Recommended Action:  Staff recommends that the Urban Renewal Agency Board approve the second amendment to the Disposition and Development Agreement with Cascadia Development LLC (Cascadia) for the 295 Church Street SE redevelopment project (Attachment A of the staff report) to revise the closing date from September 25, 2007, to December 31, 2007.

      (a)  Salem Convention and Visitors Association 2007-2010 Business Plan     (CS)

             Recommended Action:  Information only. 
  
   
 *  (b)  Second Amendment to the Disposition and Development Agreement for the 295 Church Street SE Redevelopment Project     (UD)

            Recommended Action:  Staff recommends that City Council approve the second amendment to the Disposition and Development Agreement with Cascadia Development LLC (Cascadia) for the 295 Church Street SE redevelopment project (Attachment A of the staff report) to revise the closing date from September 25, 2007, to December 31, 2007.

5. PUBLIC HEARINGS:   (Includes deliberations and deliberations from hearings held over from previous meetings). Public hearings will commence no later than 7:30 p.m.

    (a) Deliberations: Sidewalk Repair Program and Revisions to Salem Revised Code Chapter 78, Sidewalks     (PW)

          Recommended Action:  Staff recommends that the City Council advance Ordinance Bill No. 99-07 to second reading for enactment. Ordinance Bill No. 99-07 amends SRC Chapter 78, Sidewalks, making technical changes, assigning responsibility for sidewalk repairs, requiring disclosure of sidewalk defects, and specifying procedures for enforcement actions. Staff further recommends that Council approve the following components of a Sidewalk Repair Program:          1)  Creation of a Sidewalk Repair Loan Assistance Program to be funded up to $100,000 per year out of the $1 million in Qwest Reserve Funds set aside for sidewalk improvements, with the procedures and loan eligibility criteria as set forth in Attachment A of the staff report.  2)  Implementation of a City Sidewalk Repair Program for sidewalks damaged by City street trees to be funded up to $150,000 per year out of the $1 million in Qwest Reserve Funds set aside for sidewalk improvements.  This is in addition to the extra $57,000 approved by the Budget Committee to be used for repairing tree-damaged sidewalks in the FY2007/2008 budget (total budget: $250,000).  Staff will return to Council with an action plan containing criteria for prioritizing repair of tree-damaged sidewalks.  3) Continuation of the City’s grind and patch program for minor sidewalk repairs as funded by the Council on an annual basis. 4) Exploration of the use of future federal Community Development Block Grant funds to address sidewalk repairs in neighborhoods that meet the eligibility requirements for the use of those funds. 5) Inclusion of properties located within the Downtown Urban Renewal District boundaries subject to property owner repair responsibility and disclosure requirements. (Note: This differs from the Task Force recommendation)

  Additionally, Staff recommends that City Council delay second reading to September 24, 2007, and then amend SRC 78, Sidewalks, by enacting Ordinance Bill No. 99-07 (Engrossed) and further amend by motion SRC 78.154 (b) by adding the following language: (b) It shall be the duty of every owner of property abutting a sidewalk, upon acquiring actual knowledge that a defective or dangerous condition in the sidewalk exists that may have been caused by trees located in public rights-of-way, to notify the Director of the existence, location, and nature of the condition. The City shall be responsible for repairs to correct damage caused by trees located in public rights-of-way, as well as all repairs to curb ramps at street corners and intersections, subject to yearly appropriations and as prioritized by the Council.
