  Recommended Action:  Staff recommends that the Commission adopt Resolution No. 2038 and 2039.


3.2 Resolution No. 2040 Authorizing Revision to the Public Housing Admission Policy    

Recommended Action:  Staff recommends that the Commission adopt Resolution No. 2040.


3.3 Resolution No. 2041 Approval of 2007-2011 Collective Bargaining Agreement

Recommended Action:  Staff recommends that the Commission adopt Resolution No. 2041, authorizing execution of the successor collective bargaining agreement.

2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES:  Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.  
   
   (a) Social Service Advisory Board  2007-08 Work Plan

         Recommended Action:  Staff recommends that City Council approve the Social Service Advisory Board's 2007-08 Work Plan.

   
3.   PUBLIC COMMENT:  Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.

     4.1 MINUTES:

    (a) September 24, 2007

    4.2 RESOLUTIONS:

   (a) Resolution No.2007-92 Authorizing Negotiation for the Acquisition of Property for the Center Street NE and 17th Street NE Traffic Signal Project  - Wards 1 and 2 - Councilors Bennett and Tesler - NEN and SESNA     (PW)

    Recommended Action:  Staff recommends that City Council approve Resolution No. 2007-92 to negotiate for the acquisition of right-of-way and easements for the construction of the Center Street NE and 17th Street NE traffic signal project.


   4.3 ROUTINE ITEMS:       
   
   (a) Appointment of Municipal Judges Pro Tempore      (AS)

    Recommended Action:  Judge Aiken respectfully requests Council appointment of  Mark J. Geiger, Ronald Hellewell, Velda Rogers and Vance Day as Municipal Judges Pro Tempore effective October 1, 2007.


   (b)  Purchases Approved Administratively - August 28, 2007 thru September 18, 2007     (AS)

    Recommended Action:  Information only.  


    (c)  Administrative Decision - Conditional Use Case No. 07-1 - Salem Keizer Public Schools - 1776 Titan Avenue NW - Ward 8 - Councilor Clem - West Salem     (CD)

     Recommended Action:  Receive and File.


     (d)  Options for Terminal Expansion to Alleviate Congestion - Ward 2 - Councilor Tesler - SEMCA     (CD)

      Recommended Action:  Information only.


      (e) Intergovernmental Agreement with the Salem-Keizer School District for the After-school P.O.W.E.R. Program     (CS)  

      Recommended Action:  Staff recommends that City Council: 1) Authorize the City Manager to execute the attached IGA with the Salem-Keizer School District to cooperatively present the middle school afterschool POWER  Program; and 2) amend the 2007-08 budget to accept a $9,806 grant from Polk County to help support the POWER Program.


      (f) Proposed Public Communications Enhancement Plan for Neighborhood Services     (CS)

      Recommended Action:  Staff recommends that City Council approve the proposed Public Communications Enhancement Plan for Neighborhood Services that provides centralized City management of a variety of resources and services, and allows neighborhood associations to identify those that best meet their unique needs.

 *  (g) Appeal of Marion County Circuit Court Decisions in City of Salem v. Laurel Guillen and City of Salem v. Stephenie Michaelena Lawrow    (Legal)

      Recommended Action:  Staff recommends that City Council appeal of the decisions of the Marion County Circuit Court in City of Salem v. Laurel Guillen and City of Salem v. Stephenie Michaelena Lawrow.


     (h) 3 Flags Safety Belt Enforcement Grant Renewal Request     (PD)

     Recommended Action:  Staff recommends that City Council authorize the Salem Police Department to apply for, and accept, a renewal of up to $9,600 for a 3 Flags Safety Belt Enforcement grant.
    

   (i) DUII Enforcement Grant Renewal Request     (PD)

   Recommended Action:  Staff recommends that City Council authorize the Salem Police Department to apply for, and accept, a renewal of a DUII Overtime Enforcement grant in the amount of up to $18,000.


   (j) Quitclaim a 10-foot-wide "Grant of Right-of-way" permanent easement along with an additional strip of land being 30 feet each side of the existing centerline, not to exceed 60 feet in total width, previously required for the construction of the 36-inch transmission main, Stayton Island Filtration Facility to Fairmount Reservoir in 1936 - Ward 3 - Councilor Nanke - Morningside     (PW)

   Recommended Action:  Staff recommends that City Council authorize staff to execute a quitclaim deed for the easement area to the underlying owner as shown on Exhibit B of the staff report.


   (k) 2008 Transportation Bond Public Involvement Plan Update - Focus Group and Poll Results Summary     (PW)
 
    Recommended Action:  Information only.

     8.1 FIRST READING OF ORDINANCE BILLS

    (a) Ordinance No. 112-07  Establishing Administrative Procedures for Rulemaking and Contested Case Proceedings

    Recommended Action:  Staff recommends that City Council adopt Ordinance Bill No. 112-07, establishing generally applicable administrative procedures for rulemaking and contested case proceedings and establish a City Council Subcommittee to evaluate the type of cases that should be appealable to the Hearings Officer and return to the City Council with recommendations therefore. 
 

    8.2 SECOND READING OF ORDINANCE BILLS

   (a) Second Engrossed Ordinance No. 99-07 Relating to Sidewalks; amending SRC 78.010, SRC 78.030, SRC 78.040, SRC 78.050, SRC 78.110, SRC 78.120, SRC 78.130, SRC 78.150, SRC 78.152, SRC 78.154, SRC 78.156, SRC 78.158, SRC 78.180, SRC 78.182, SRC 78.190, SRC 78.192, SRC 78.220, SRC 78.250, and SRC 78.290; repealing SRC 78.140, SRC 78.155, SRC 78.170, SRC 78.260, and SRC 78.270; and creating new provisions
