2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES:  Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.

3.   PUBLIC COMMENT:  Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.

   4.2 RESOLUTIONS:

   (a) Resolution No. 2007-99  Dedicating Tracts B and C of property located on Fitzpatrick Avenue SE and on Jamison Drive SE, as shown on the recorded plat of Shamrock Woods 1 for street and right-of-way - Ward 4 - Councilor Sullivan - South Gateway    (PW)

    Recommended Action: Staff recommends that City Council adopt Resolution No. 2007-99.        

   (b) Resolution No. 2007-101  Initiating an Amendment to Salem Revised Code Chapter 120A, Historic Preservation    (CD)

    Recommended Action: Staff recommends that City Council adopt Resolution No. 2007-101 to initiate a text amendment to SRC 120A to change the appeal body for Type II and Type III decisions from the City Council to the Hearings Officer and clarify the appeal body for demolition permits is the Hearings Officer.

    Recommended Action: Receive and File. 

  (g) Photo Red Light Update - Ward 2 - Councilor Tesler - SESNA and SEMCA   (CM and PD)

    Recommended Action: Staff recommends that City Council direct the City Manager to enter into a  Memorandum of Understanding with the Oregon Department of Transportation (ODOT) regarding the installation of a Photo Red Light Running Camera at the intersection of Mission Street and 25th Street (Oregon State Highway OR-22).

* (h) Authorizing Letter Supporting Public Housing Demolition - Ward 5 - Councilor Tarter - Highland     (CS)

    Recommended Action: Staff recommends that City Council authorize the Mayor to sign the letter attached to the staff report.

  (i) Annual Update on Contract with Rural Metro Ambulance    (FD)

    Recommended Action: Information only.

  (j) Graffiti Abatement    (PD)

    Recommended Action: Information only.

* (k) Purchase and Sale Agreement to Acquire a 0.53 Acre Parcel of land on Liberty Road in South Salem for Constructing a new Fire Station #7 Building - Ward 7 - Councilor DeHart - Sunnyslope    (UD)

    Recommended Action: Staff recommends that City Council authorize the City Manager to execute a PSA with Michael and Tonya Beach to purchase a 0.53 acre parcel located adjacent to the City owned parcel at 5021 Liberty Road in South Salem for the construction of a new fire station #7.

  (l) Appointments/Reappointments to Various Advisory Boards and Commissions

    Recommended Action: The  Council Boards and Commissions Appointments Committee recommends that City Council appoint/reappoint the candidates listed in the Facts and Findings section of the report.


5.   SPECIAL ORDERS OF BUSINESS:    (Includes consideration of items deferred from the consent calendar and any action item which requires a selection among options, or consideration of matters of special importance to the Council)

7.   PUBLIC HEARINGS:  (Includes deliberations and deliberations from hearings held over from previous meetings). Public hearings will commence no later than 7:30 p.m.
      
  (a) Prime Investments LLC Temporary Facilities Access Agreement - Ward 7 - Councilor DeHart - Sunnyslope    (PW)

    Recommended Action:  Staff recommends that City Council approve the Temporary Facilities Access Agreement with Prime Investments LLC, and authorize the City Manager to sign it.

 (b) Amendments to the Salem/Keizer Consortium 2006/2007 and 2007/2008 One Year Action Plans    (UD)

    Recommended Action:  Staff recommends that City Council approve the    Salem/Keizer Consortium 2006/2007 and 2007/2008 One Year Action Plan amendments that allocate Community Development Block Grant (CDBG) and HOME funds.   

 (c) Tax-Exempt Fiscal Responsibility Act - 295 Church Street Project Financing - Authorization to issue financing for office and production facilities for public, education, and governmental (PEG) access cable programming - Ward 2 - Councilor Tesler - CAN-DO    (AS)
 
    Recommended Action:  Staff recommends that City Council hold a Tax-Exempt Fiscal Responsibility Act (TEFRA) hearing in order to provide a reasonable opportunity for members of the public to express their views, orally or in writing, regarding the tax-exempt financing and the uses and purposes of the proceeds.  The TEFRA hearing is required by the Internal Revenue Service, as a public accountability procedure when tax-exempt financing is used in connection with non-profit activity; Capital Community Television (CCTV).

    Upon the closing of the public hearing, Council may consider approval of recommendation #2: That City Council adopt Resolution No. 2007-98, authorizing the Administrative Services Director to execute the necessary documents to enter into a financing agreement with and pledge the City’s full faith and credit to, Bank of America, the City’s Financing Entity of Record. Repayment of the financing is expected to be made from existing and future PEG access capital funds.

  
8. CALENDAR OF ORDINANCE BILLS:

 8.1 FIRST READING OF ORDINANCE BILLS

 (a)  Ordinance No. 115-07  Relating to Notification Procedures for the Property Owners of Potential Enclave Areas; amending SRC 165.130; and creating new provisions    (CD)
   
   Recommended Action: Staff recommends that City Council advance Ordinance No. 115-07 to second reading for enactment.  Enactment of Ordinance No. 115-07 will amend SRC Chapter 165 to require notification of property owners of potential enclaved areas.

 (b)  Ordinance No. 119-07  Relating to The Salem Transportation System Plan, and amending SRC 64.230    (PW)

   Recommended Action:  Staff recommends that City Council advance Ordinance No. 119-07 to second reading for enactment. 

 (c)  Ordinance No. 121-07  Declaring certain territory located at 3887 Homestead Road S, annexed to the City of Salem, prescribing zoning, and  withdrawing the territory from the Salem Suburban Rural Fire Protection District - Ward 7 - Councilor DeHart - Croisan-Illahe    (CD)

   Recommended Action:  Staff recommends that City Council advance Ordinance No. 121-07 to second reading for enactment.

   Note: Public hearing was held September 4, 2007.

 (d)  Ordinance No. 122-07  Declaring certain territory located at 3831 Homestead Road S, annexed to the City of Salem, prescribing zoning, and  withdrawing the territory from the Salem Suburban Rural Fire Protection District - Ward 7 - Councilor DeHart - Croisan-Illahe    (CD)

   Recommended Action:  Staff recommends that City Council advance Ordinance No. 122-07 to second reading for enactment.

   Note: Public hearing was held September 4, 2007 and continued to September 24, 2007.


 8.2  SECOND READING OF ORDINANCE BILLS

 (a) Ordinance No. 114-07  Relating to the Pine Street Mixed-use Area (Area 1) of the Portland/Fairgrounds Road Overlay Zone; Amending SRC 121.520; SRC 121.600; SRC 121.660; SRC 143B.080; and SRC 143B.170; and creating new provisions - Ward 5 - Councilor Tarter - Highland    (CD)
