4.  ACTION ITEMS:

    * (a)  Resolution No. 2008-17  Dedicating property located on the west side of Turner Road SE, from the entrance road to Cascade Gateway Park to the south side of the Garmin Industries frontage for street and right-of-way - Ward 2 - Councilor Tesler - SEMCA    (PW)

   Recommended Action: Staff recommends that City Council adopt Resolution No. 2008-17 dedicating currently owned City property as public right-of-way to facilitate the Turner Road SE Improvement Project as shown on Exhibits A and B.

   * (b) Resolution No. 2008-24  Dedicating property located on the southwest corner of the intersection of Parkway Drive and Glen Creek Road NW for street and right-of-way - Ward 8 - Councilor Clem - West Salem    (PW)

   Recommended Action: Staff recommends that City Council adopt Resolution No. 2008-24.

 
   * (c) Resolution No. 2008-27 Authorizing Negotiation for the Acquisition of Permanent Easements for Construction of the Turner Road SE Sidewalk and Street Light Project - Ward 2 - Councilor Tesler - SEMCA    (PW)
   
   Recommended Action:  Staff recommends that City Council adopt Resolution No. 2008-27 declaring intent to negotiate for acquisition of easements for the construction of the Turner Road SE Sidewalk and Street Light Project.


   * (d)  Resolution No. 2008-28 Amending “Exhibit 2" of Resolution No. 2008-11 Creating a Part-time Employee Parking Permit for Specific On-street Locations Within the Downtown Area and Establishing Fees and Charges for Parking Services - Ward 2 - Councilor Tesler - CAN-DO    (AS)

    Recommended Action:  Staff recommends that City Council adopt Resolution No. 2008-28 to establish the following parking fees: 1) fee increases from $56 to $70 in three phases at Liberty Square Parkade; 2) fee increases from $35 to $50 in three phases at Pringle Parkade; 3) a downtown on-street scratch-off permit ($6.00 per day) for customers; and 4) passport application and processing fees set by the US State Department.
 

   * (e) Reappointment of Municipal Judges Pro Tempore    (AS)
   
   Recommended Action:  The Honorable Jane Aiken requests that the Municipal Judge Pro Tempore, Jon Weiner and Robert Williamson, be re-appointed by Council to serve another term in this position.

   Recommended Action:  Staff recommends that City Council adopt Alternative (1): A task force be formed with three members of Council and three members of the Airport Advisory Commission (AAC) to review existing policies regarding fuel facilities at McNary File and to make appropriate recommendations for policy changes.


     * (r)  Salem Saturday Market Annual Noise Variance - Ward 2 - Councilor Tesler - CAN-DO    (CD)  

   Recommended Action:  Staff recommends that City Council grant a noise variance for the Salem Saturday Market events, and that the conditions listed in the report become requirements of the variance.


     * (s)  Library Services and Technology Act Grant    (Library)
 
   Recommended Action:  Staff recommends that City Council authorize staff to apply for, and execute a grant contract with the Oregon State Library, for the final year of a Library Services and Technology Act (LSTA) grant in the amount of $37,540.


     * (t)  Acceptance of an Oregon Water Supply and Conservation Initiative Grant    (PW)

   Recommended Action:  Staff recommends that City Council approve the acceptance of an Oregon Water Resources Department Water Supply and Conservation Initiative grant in the amount of $20,000 if awarded on April 15, 2008.
 

     * (u)  Multiple Account Water/Sewer Customer Billing Processes    (PW)

   Recommended Action:  Staff recommends that the City: 1) Offer expanded consolidated billing services to qualified customer accounts on a case-by-case basis. The expanded services include customizing electronic billing and reporting functionality based on the customer's preferred method of billing and reporting;   2) Approve a new fee schedule for customized consolidated billing and reporting; and 3) Allow the designated parties (either landlord or tenant) to sign up for water and sewer service upon request.


     * (v)  Set public hearing for second Petition-Initiated Vacation of Unopened Bellevue Street SE Right-of-Way, between Liberty Street SE and High Street SE - Ward 2 - Councilor Tesler - Ward 2 - Councilor Tesler - SEMCA    (PW)

   Recommended Action:  Staff recommends that City Council direct the City Manager Pro Tem to set a Public Hearing to receive input on the second proposed Bellevue Street SE right-of-way vacation.

   
     * (w)  Water and Sewer Rate Surcharge for Outside Jurisdictions     (PW)

   Recommended Action:  Staff and City Council ad hoc committee recommends phasing out the 7.5 percent water and sewer rate surcharge for the cities of Keizer and Turner at a rate of 1½ percent in 2009, and 1 percent per year from 2010 through 2015.

   
    * (x) Energy and Environmental Management Update    (PW)

   Recommended Action:  Information only.


     * (y)  Appeal of Airport Advisory Commission Recommendation to Issue an Operating License - Ward 2 - Councilor Tesler - SEMCA    

   Recommended Action:  Staff recommends that City Council direct staff to schedule a public hearing to review the recommendation of the AAC based on receiving an appeal under Salem Revised Code (SRC) Chapter 9.020 and provide notice of the hearing.

5.  PUBLIC HEARINGS:   (Includes deliberations and deliberations from hearings held over from previous meetings). Public hearings will commence no later than 7:30 p.m.
 
  (a) Deliberations - Proposed Referral of the November 2008 Streets and Bridges General Obligation Bond Measure    (PW)

   Recommended Action:  The Council Streets and Bridges Bond Committee and staff recommend that City Council direct staff to prepare a measure, ballot title, explanatory statement, and other documents necessary to refer to the voters a general obligation bond measure to improve the City’s streets and bridges for the November 4, 2008, general election. It is further recommended that: 1) The total amount of bonding authority not exceed $98,600,000, including the cost of issuing bonds and capital program administration; 2) The proposed bonding authority be used to design and construct the projects illustrated in Attachment A and listed in  Tables 1 (page 7) and 2 (page 9) of the staff report; 3) The bonding authority be issued in multiple sales of 15-year bonds that obtain proceeds needed to fund projects and maintain the lowest increase in the property tax levy for repayment of the bonds; and 4) As the list of approved projects nears completion, staff bring forward for Council consideration use of the accumulated savings from completed projects and accrued interest earnings, in excess of program administrative costs, for funding the projects listed in Table 3 (page 18) of the staff report.
