2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES:  Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.  

      
3.   PUBLIC COMMENT:  Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.

   4.2 RESOLUTIONS:

    (a)  Resolution No. 2008-29  Dedicating property located on the 23rd Street SE Extension to Mission Street SE for street and right-of-way - Ward 2 - Councilor Tesler - SESNA    (PW)
 
    Recommended Action: Staff recommends that City Council adopt Resolution No. 2008-29.

   
   (b) Resolution No. 2008-31  Dedicating property located south of Glen Creek Road NW, southerly to the intersection of the Southern Pacific Railroad right-of-way for street and right-of-way - Ward 8 - Councilor Clem - West Salem    (PW)
 
    Recommended Action: Staff recommends that City Council adopt Resolution No. 2008-31.

   (c) Resolution No. 2008-32  Authorizing a Transfer of Appropriation to be Expended for the Purpose of Augmenting the Historic Facility Maintenance Reserve    (CM)
 
    Recommended Action: Staff recommends that City Council adopt Resolution No. 2008-32 transferring $40,000 within the Cultural and Tourism Fund from contingency to materials and services to augment the historic facility maintenance reserve at the recommendation of the City of Salem Budget Committee.

   (d) Resolution No. 2008-33    Authorizing an Inter-City Loan from Fleet Services Division to Senior Center Construction - Ward 5 - Councilor Tarter - Highland  (CM)

    Recommended Action:  Staff recommends that City Council adopt Resolution No. 2008-33 authorizing an inter-fund loan in the amount of $1,924,000 between the Fleet Services Division and the Capital Improvements Fund, Senior Center Construction Division, to provide the short term financing necessary to complete construction of the new Senior Center.

   (b) Historic Landmarks & Design Review Commission Decision - Historic Review Case No. HIS08-2 - City of Salem Parks & Recreation - 600 Mission Street SE (Bush’s Pasture Park) - Ward 2 - Councilor Tesler - SCAN    (CD)

    Recommended Action: Receive and File.

  * (c) Capital Projects Advisory Board Public Hearing Regarding Oregon State Hospital and Penitentiary Properties Area Plan    (CD)

    Recommended Action:  Pending.

   (d) Use of Property Adjacent to the Salvation Army Ray and Joan Kroc Corps Community Center - Ward 5 - Councilor Tarter - Northgate    (CS)

    Recommended Action:  Staff recommends that City Council refer this issue to the North Gateway Urban Renewal Advisory Board, requesting up to $245,000 in Urban Renewal Funds to develop specific plans for this site.  The funds would support a topographical survey, a park master plan, construction documents, and construction cost estimates. 

   (e)  Annual Volunteer Report    (CS)

   (a) Continuation:  Petitioner-Initiated Annexation of Territory Located at 5122 Hayesville Drive NE (Annexation Case No. C-664) - Ward 5 - Councilor Tarter - Northgate    (CD)   
 
    Recommended Action:  Staff recommends that City Council: 1) Find that Petitioners submitted a valid triple majority consent petition for annexation of the Territory and thus an election is   dispensed with in the Territory proposed to be annexed; 2) Determine that Annexation Case No. C-664 satisfies the criteria of Salem Revised Code (SRC) 165.130 (c) and adopt Order No. 08-C-664, which is Attachment I of the staff report; 3) Refer the proposed annexation to the November 4, 2008 election ballot, and, if approved by the voters: A) Change the
Salem Area Comprehensive Plan Map designation from “Developing Residential” to “Multi-Family Residential”; B) Rezone the Territory from a Marion County UT-5 (Urban Transition) zone to City of Salem RM1 (Multiple Family Residential) zone; and C) Withdraw the Territory from Marion County Fire District #1. 

   (b) Appeal of Decision of the Historic Landmarks & Design Review Commission of Historic Review Case No. 08-1; 235 15th Street NE - Ward 1 - Councilor Bennett - NEN    (CD)

    Recommended Action:  Staff recommends that City Council affirm the Historic Landmarks & Design Review Commission decision that approved the request with conditions and adopt Order No. 2008-02-HDR on April 14, 2008.

   (c) Council Review of Variance 08-1 - Ryan Burdue - 4130 Portland Road NE - Ward 5 - Councilor Tarter - Northgate    (CD)

    Recommended Action:  Staff recommends that City Council affirm the decision of the Hearings Officer and adopt Order No. 2008-01-VAR on April 14, 2008, to deny the request for three secondary signs consisting of two 155 square foot wall signs and one 126 square foot wall sign, but grant a request for one 155 square foot secondary wall sign located on the north elevation of the building.  The property for Value Place Hotel located at 4130 Portland Road NE is in the Portland/Fairgrounds Road Overlay Zone and zoned CR (Commercial Retail) (Attachment A of the staff report). Findings and Order issued by the Hearings Officer on March 6 2008 is presented in Attachment B of the staff report.

  (a) Ordinance Bill No. 16-08  Relating to Building Codes, Amending SRC 56.001 and 56.012,  and declaring an emergency    (CD)

   Recommended Action: Staff recommends that City Council advance Ordinance Bill No. 16-08 to second reading for enactment and direct staff to return with
   Resolution No.2008-21 on April 28, 2008 to add an enhanced or expedited services hourly rate to the Building and Safety fee schedule.
