C. PUBLIC COMMENT:   (Comment on specific agenda items other than public hearings and deliberations.  Each person’s comments will be limited to three minutes.)

  
D. ACTION ITEMS:

      * (1)   Exclusive Negotiation Agreement between City of Salem, Urban Renewal Agency, and Marion Park, LLC Relating to the Potential Transfer of Air Rights and Development of Marion Parkade - Ward 2 - Board Member Tesler -        CAN-DO    (UD)

    Recommended Action:  Staff recommends that the Urban Renewal Agency Board: 1) Enter into an exclusive negotiation agreement (ENA) with the City of Salem (City) and Marion Park, LLC, allowing the Agency to negotiate with Marion Park, LLC the potential transfer of air rights and redevelopment of the Marion Parkade; and 2) Authorize the use of Riverfront-Downtown Urban Renewal Area funds to pay for the predevelopment/planning costs associated with the potential transfer of air rights and redevelopment of the Marion Parkade.


     * (2)  Minto Brown Island Bike-Pedestrian Bridge and Multi Use Path Project Funding Approval - Wards 2, 7 and 8 - Board Members Tesler, DeHart and Clem - SCAN, CAN-DO, South Salem, Croisan-Illahe and West Salem    (UD)

    Recommended Action:  Staff recommends that the Urban Renewal Agency Board approve an Intergovernmental Agreement (IGA) with the City of Salem to provide the matching funds for an application for a Transportation Enhancement Program (TE Program) from the Oregon Department of Transportation (ODOT) for the Minto Brown Island Bike-Pedestrian Bridge and Multi Use Path Project (Project).


     * (3)   Fairview Urban Renewal Area   
    Resolution No. 08-6 URA Classifying and Approving a Minor Amendment to the Fairview Urban Renewal Plan - Ward 3 - Board Member Nanke - Morningside     (UD)

    Recommended Action:  Staff recommends that the Urban Renewal Agency Board: 1) Amend the CC&R’s on the vacant property located at 2045 Madrona Avenue SE, by replacing them with a limited form of CC&R’s and include a provision that the limited CC&R’s will be terminated upon issuance of a certificate of occupancy for the property as outlined in Attachment A of the staff report; 2) Terminate the existing CC&Rs on the vacant 1.77 acre Single Family zoned property at 3450 Edward Drive SE as outlined in Attachment B of the staff report; and 3) Adopt Resolution No. 08-6 URA to allow limited residential development in the single family zoned area located at 3450 Edward Drive SE in the Fairview Urban Renewal Area adjacent to existing residential uses.

2.  REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES:  Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.  

   (a) Annual Report of the Salem Cultural and Tourism Promotion Advisory Board (CM)

    Recommended Action:  Information only.

         
3.   PUBLIC COMMENT:  Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.

   4.2 RESOLUTIONS:

   (a) Resolution No. 2008-34 Dedicating property located at the intersection of Salem Industrial Drive NE and Hyacinth Street NE, the extension of Salem Industrial Drive southerly to the Kroc Center for a street and right-of-way - Ward 5 - Councilor Tarter - Northgate    (PW)
 
    Recommended Action: Staff recommends that City Council adopt Resolution No. 2008-34. 

   (b) Resolution No. 2008-35 Dedicating property located on the north line of Center Street and east of 17th Street NE; also on the east line of 17th Street north of Center Street NE for a street and right-of-way - Ward 1 - Councilor Bennett - NEN    (PW)

    Recommended Action:  Staff recommends that City Council adopt Resolution No. 2008-35.


   (c) Resolution No. 2008-38 Authorizing a Transfer of Appropriation within the Cultural and Tourism Fund to be Expended for the Purpose of Emergency Replacement of the Heating and Cooling System at the Marion County Historical Society - Ward 2 - Councilor Tesler - SESNA    (CM)

    Recommended Action:  Staff recommends that City Council approve Resolution No. 2008-38 transferring $8,500 within the Cultural and Tourism Fund from contingency to materials and services to fund the emergency replacement of  furnaces and heat pumps at the Marion County Historical Society.

    Recommended Action:  Staff recommends that City Council direct staff to convert five parking spaces to disabled parking in the area adjacent to the State Capital Building.

   Recommended Action: Staff recommends that City Council approve and authorize the City Manager Pro Tem to execute an Agriculture Use Lease for the City-owned property at Willow Lake Water Pollution Control Facility.

  (j) Set Public Hearing for Petition-Initiated Vacation of unopened Wilson Street S right-of-way, between John Street S and River Road S - Ward 7 - Councilor DeHart - South Salem    (PW)
 
   Recommended Action:  Staff recommends that City Council direct the City Manager Pro Tem to set a Public Hearing to receive input on the petition-initiated vacation of Wilson Street S right-of-way, between John Street S and River     Road S.
  

 * (k)  Union Street Railroad Bridge Connections Transportation Enhancement Application - Wards 1 and 8 - Councilors Bennett and Clem - CAN-DO and West Salem    (PW)

   Recommended Action:  Staff recommends that City Council endorse submitting an application to the ODOT Transportation Enhancement Program for improved bicycle and pedestrian connection to the Union Street Railroad Bridge and authorize the City Manager Pro Tem to sign the application form.


 * (l)  Utility Easement at 3611 State Street for Fire Station #10 - Ward 6 - Councilor Rogers - NESCA    (PW)

   Recommended Action:  Staff recommends that City Council authorize City Manager Pro Tem Linda Norris to sign a utility easement to provide electrical service at 3611 State Street.

 (a) Appeal of Airport Advisory Commission Recommendation Regarding Helicopter Flight School - Ward 2 - Councilor Tesler - SEMCA
  
  Recommended Action: Staff recommends that City Council: 1) Affirm the recommendation of the Airport Advisory Commission; 2) Require Leading Edge Helicopters to comply with the Community Interface Procedure (Attachment A of the staff report) and guidelines in the Helicopter Association International, Fly Neighborly Guide, Third Edition (Attachment B of the staff report); 3) Determine that financial and location information submitted by the applicant is complete; and 4) Direct staff to establish a Noise Abatement Committee at McNary Field and develop an overall program for handling noise complaints.

 (b) Continuation: Appeal of Decision of the Historic Landmarks & Design Review Commission of Historic Review Case No. 08-1; 235 15th Street NE - Ward 1 - Councilor Bennett - NEN    (CD)
 
  Recommended Action: Staff recommends that City Council affirm the Historic Landmarks & Design Review Commission decision that approved the request with conditions and adopt Order No. 2008-02-HDR. 
   

 (c) 2008 - 2009 Housing and Community Development Annual Action Plan    (UD)

  Recommended Action: Staff recommends that City Council adopt the 2008-2009 Housing and Community Development (HCD) Action Plan (Plan)
  and direct staff to submit the 2008-2009 Plan to the Department of Housing and Urban Development (HUD) prior to May 15, 2008.


 (d) Second Petition-Initiated Vacation of Bellevue Street SE right-of-way, between Liberty Street SE and High Street SE - Ward 2 - Councilor Tesler -  CAN-DO  (PW)

  Recommended Action: Staff recommends that City Council approve the second petition-initiated vacation of Bellevue Street SE right-of-way, between Liberty Street SE and High Street SE, subject to the condition that the adjacent property owners pay an assessment of special benefit in the amount of $79,600.
