2.   REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES:  Representatives of City Boards, Commissions and Committees may comment on any item of City business except public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Representatives must sign up prior to the commencement of this meeting in order to present testimony.  

   (a) Appointments/Reappointments to Various Advisory Boards and Commissions

    Recommended Action:  The Council Boards and Commissions Appointments Committee recommends that City Council appoint the candidates listed in the Facts and Findings section of the report.


3.   PUBLIC COMMENT:  Up to thirty minutes is available for persons other than City Boards, Commissions and Committee representatives to comment on specific agenda items other than public hearings, deliberations and the merits of land use issues that are reviewable by Council at public hearings.  Each person’s comments will be limited to three minutes.

   Time will be provided at the end of the meeting for comments on issues of City business not on the agenda.

   (a) Resolution No. 2008-44  Declaring Intent to Negotiate for the Acquisition of Temporary and Permanent Easements for the Construction of a Water Line Along the Future Alignment of Fabry Road SE, from Reed Lane SE to Battle Creek Road SE - Ward 4 - Councilor Sullivan - South Gateway    (PW)

    Recommended Action:  Staff recommends that City Council approve Resolution No. 2008-44 declaring intent to negotiate for the acquisition of temporary construction easements and a permanent easement for the construction of a new 20-inch water line to be built along the future alignment of Fabry Road SE, from Reed Lane SE to Battle Creek Road SE.

    Recommended Action:  Staff recommends that City Council adopt Resolution No. 2008-45 through 2008-59 to initiate annexation of 15 enclaved territories for inclusion on the November 4, 2008 ballot.

   (a) Agreement with Go Downtown Salem! for Administration of Economic Improvement District Funds - Ward 2 - Councilor Tesler - CAN-DO    (AS)

    Recommended Action:  Staff recommends that City Council approve the agreement attached to the staff report between the City of Salem and “Go Downtown Salem!” for services related to the Downtown Economic Improvement District.


   (b) Hearings Officer Decision - Specific Conditional Use 08-2 - Theresa Rogers - 925 Hood Street NE - Ward 1 - Councilor Bennett - Grant    (CD)

    Recommended Action:  Receive and File.

    Recommended Action:  Staff recommends that City Council authorize the City Manager Pro Tem to sign an agreement with the Oregon Department of Transportation (ODOT) for the repair and paving of 37th Avenue SE, east of Turner Road SE, and the portion of Turner Road SE, located under the Interstate 5 overpass, by ODOT as part of the Interstate 5 widening project.


 *  (g)  2008 Technical Assistance Grant Application to Oregon Watershed Enhancement Board (OWEB)    (PW)
     
    Recommended Action:  Staff recommends that City Council allow the Public Works Department to apply as a co-applicant on the grant application submitted by Oregon Watersheds to OWEB.

   (a) Continuation: Appeal of Decision of the Historic Landmarks & Design Review Commission of Historic Review Case No. 08-1; 235 15th Street NE - Ward 2 - Councilor Tesler - NEN    (CD)

    Recommended Action:  Staff recommends that City Council affirm the Historic Landmarks & Design Review Commission decision that approved the request with conditions and adopt Order No. 2008-02-HDR.
  
   
   (b) Petitioner-Initiated Annexation of Territory Located at Lot 3, Block 3, Chatnicka Heights (3100 Block of Glen Creek Road NW) (Annexation Case No. C-657) - Ward 8 - Councilor Clem - West Salem    (CD)    

    Recommended Action:  Staff recommends that City Council:  1) Find that the Petitioners submitted a valid triple majority consent petition for annexation of the Territory and thus an election is dispensed with in the Territory proposed to be annexed.  2) Determine that Annexation Case No. C-657 satisfies the criteria of Salem Revised Code (SRC) 165.130(c) and adopt Order No. 08-C-657, Attachment I of the staff report.  3) Refer the proposed annexation to the November 4, 2008 election ballot, and, if approved by the voters: A) Apply the City of Salem RS (Single Family Residential) zone to the Territory from a Polk County SR (Suburban Residential) zone; and  B) Withdraw the Territory from the Salem Suburban Rural Fire Protection District.

   (c) Petitioner-Initiated Annexation of Territory Located West of Cordon Road NE (4500 Block) (Annexation Case No. C-661) - Ward 5 - Councilor Tarter - Northgate    (CD)

    Recommended Action:  Staff recommends that City Council: 1) Find that the Petitioners submitted a valid triple majority consent petition for annexation of the Territory and thus an election is dispensed with in the Territory proposed to be annexed.  2) Determine that Annexation Case No. C-661 satisfies the criteria of Salem Revised Code (SRC) 165.130(c) and adopt Order No. 08-C-661, Attachment I of the staff report.  3) Refer the proposed annexation to the November 4, 2008 election ballot, and, if approved by the voters: A) Apply the City of Salem RA (Residential Agriculture) zone to the Territory from a Marion County UT-5 (Urban Transition - 5 acres) zone; and  B) Withdraw the Territory from Marion County Fire District #1.
