Council adopted Resolution #2005-51 in July 2005 implementing the Land Use and Transportation Strategies and the Integrated Land Use and Transportation Alternative Standard Benchmarks.
Subsequently, the City submitted a completion report to the Department of Land Conservation and Development (DLCD). DLCD requested a sixty day extension to complete review of the City’s submittal.
In February 2006, DLCD decided to remand the work to the City with a finding that the City’s submittal failed to comply with the Transportation Planning Rule (Order #001691). In response, Council decided to appeal the DLCD remand. Council also agreed to enter into mediation with DLCD regarding the City’s Periodic Review submittals.
Mediation commenced late in 2006 with a meeting between City representatives, including the Mayor and Council members, and the Director of DLCD. A second meeting followed in 2007. Since then, City and State officials have made several contacts to bring the mediation effort to a successful conclusion.
In the meantime, DLCD staff has been asking the Land Conservation and Development Commission (LCDC) at its meetings every other month for a continuation of the Commission’s review of this matter to a future LCDC meeting, pending the outcome of the mediation effort.
