4.2 RESOLUTIONS: (a) Resolution No. 2007-34 Declaring Intent to Negotiate for the Acquisition of Temporary Easements for the Construction of the State Street NE at Mill Creek Bridge Rehabilitation - Ward 2 - Councilor Tesler - NEN and SESNA (PW)
Recommended Action: Staff recommends that City Council adopt Resolution No. 2007-34 declaring intent to negotiate for the acquisition of easements for the construction of the State Street NE at Mill Creek Bridge rehabilitation.
* (b) Resolution No. 2007-35 Authorizing a Transfer of Appropriation of $45,000 to be Expended for the Purpose of Providing Street Paving Asphalt Work (PW)
Recommended Action: Staff recommends that City Council approve Resolution No. 2007-35 transferring $45,000 from Public Works Fund capital outlay to Public Works Fund materials and services to perform street maintenance activities.
* (c) Resolution No. 2007-36 Authorizing the City’s Application to the Oregon State Marine Board for a Grant to Remedy the Bank Erosion Problem at Wallace Marine Park - Ward 8 - Councilor Clem - West Salem (CS) Recommended Action: Staff recommends that City Council approve Resolution No. 2007-36, authorizing the City’s application to the Oregon State Marine Board for a grant to do an assessment and design to remedy the bank erosion problem at Wallace Marine Park.

Recommended Action: Information only.
(b) Initiate an Amendment to the Salem Revised Code Chapter 165 (Annexation Procedures) to Require Notification of Owners of Potential Enclaved Areas (CD)
Recommended Action: Staff recommends that City Council adopt a resolution to: 1) initiate an amendment to SRC 165.130 to require notification of owners of potential enclaved areas; 2) refer the matter to the Salem Planning Commission for its recommendation; and 3) direct the Urban Planning Administrator to set a date for a public hearing before the Salem Planning Commission to receive testimony concerning the proposed amendment.
(c) Fire Station Preliminary Design Information Sharing Schedule - Wards 6, 7 and 8 - Councilors Rogers, DeHart and Clem - NESCA, Sunnyslope and West Salem (FD)
Recommended Action: Staff recommends that City Council approve the information sharing schedule for fire station preliminary designs.
(d) Update on City “No Meth” Efforts (PD)
Recommended Action: Information only.

Recommended Action: It is recommended that City Council ratify City Manager’s decision to support House Bill 3547 and House Joint Resolution 56.

Recommended Action: Staff recommends that Council approve the Temporary Facilities Agreement with Donald Wyant, Sr. Family Trust, and authorize the City Manager to sign it.
(b) Council Review of Planning Commission Decision - Comprehensive Plan Change / Zone Change No. 06-6 - Pacific Realty Associates, L.P. - 2500 Block of Boone Rd SE - Ward 4 - Councilor Sullivan - South Gateway (CD) Recommended Action: Staff recommends that City Council affirm the decision of the Planning Commission to approve with conditions, the request to change the Salem Area Comprehensive Plan Map designation from “Developing Residential” to “Commercial” and to change the zoning from RA (Residential Agriculture) to CR (Commercial Retail) for an 18.4-acre site located in the 2500 Block of Boone Road SE (Marion County Assessor’s Map Number: T08S R3W S12 Quarter Section C, Tax Lots 1800, 1900, 2000, 2100). The decision and conditions of approval are as required in the Planning Commission Resolution 06-19 issued February 6, 2007 (Attachment B of the staff report).

8.1 FIRST READING OF ORDINANCE BILLS
(a) Ordinance No. 88-07 Relating to Prohibiting Certain Uses Not Consistent with the West Salem Neighborhood Plan within the Edgewater Street Corridor (Area 5) of the Edgewater Street/Wallace Road Area Overlay Zone; Amending SRC 143D.190; and Creating New Provisions - Ward 8 - Councilor Clem - West Salem (CD)
Recommended Action: Staff recommends that City Council: (1) Hold a public hearing to consider adoption of Ordinance No. 88-07, amending SRC Chapter 143D to prohibit automobile-oriented and other certain uses that are not consistent with the West Salem Neighborhood Plan within the Edgewater Street Corridor; and (2) Advance Ordinance Bill No. 88-07 to second reading. Enactment of Ordinance Bill No.88-07 will amend SRC Chapter 143D to prohibit automobile-oriented and other uses that are not consistent with the West Salem Neighborhood Plan within the Edgewater Street Corridor.
