Temporary Use Permit

Apply for a Temporary Use Permit

The temporary use permit is a process to seek approval to temporarily operate specific uses. There are two types of Temporary Use Permits, Class 1 and Class 2. Class 1 permits are reviewed administratively. Class 2 permits are reviewed administratively, after a public notice and comment period.

The following uses are subject to a Class 1 temporary use permit.

Christmas tree sales;
Construction modular;
Construction storage yard ];
Emergency shelter;
Managed temporary village with ten or fewer shelter units;
Replacement single family dwelling;
Residential sales/development office;
Safe parking shelter; and
Temporary motor vehicle and recreational vehicle sales.

The following uses are subject to a Class 2 temporary use permit.

Managed temporary village with 11 to 40 shelter units; and
Temporary and seasonal gravel parking and loading areas.

SRC Chapter 701 provides more information on each use listed above including what the use allows, operational standards, time limits of the temporary use, etc.

Location and Property Use Restrictions

The Temporary Uses listed above are not allowed in every zone. Find the zoning of your property here. Contact the Planning Information desk to see if a specific Temporary Use is allowed on your property.

Class 1 Temporary Use Permit

Procedure Type

An application for Class 1 Temporary Use Permit is processed following the Type I application procedures under SRC Chapter 300.

Process

Application. You must submit all required items listed in the application checklist section below to the Permit Application Center Portal.
Completeness review. Staff reviews your application for completeness. If the application is not complete, you will be notified as to what information is missing, and you will have 180 days to submit the additional information. You may track the status of your application online at the City of Salem permit tracking webpage.
Conformance review. Once a complete application is submitted, staff reviews the proposed plan to determine if it meets the criteria in SRC 701.
Decision. The Planning Administrator makes a decision to approve or deny your application depending on whether or not the proposal meets the applicable criteria.

Application Checklist

An application for a Class 1 Temporary Use Permit must contain the following:

Land use application form. The land use application form must be signed by the applicant(s), property owner(s), and/or duly authorized representative(s). If the applicant and/or property owner is a Limited Liability Company (LLC), please also provide a list of all members of the LLC with your land use application. The land use form will be generated for you when you submit through the Permit Application Center Portal.
Land use application fee. You must pay the application fee when you file your application.
Site plan. The site plan must include the following information:
- Total site area, dimensions, and orientation relative to north
- Location of the proposed temporary use and any other relevant information that would aid the review of the application.
Written Statement. A written statement shall be submitted describing the proposal and how it conforms to the following approval criteria for the specific Class 1 Temporary Use Permit that is being requested (SRC 701).
The statement should address the specifics standards of the Temporary Use Permit being requested, including hours of operation, operations plan, restoration plan, etc., as applicable.

Class 2 Temporary Use Permit

Procedure Type

An application for Class 2 Temporary is processed following the Type II application procedures under SRC Chapter 300.

Process

Application. You must submit all required items listed in the application checklist section below to the Permit Application Center Portal.
Completeness review. Staff reviews your application for completeness. If the application is not complete, you will be notified as to what information is missing, and you will have 180 days to submit the additional information. You may track the status of your application online at the City of Salem permit tracking webpage.
Notice and public comment. After your application is deemed complete, staff sends notice of the proposal to the applicant, property owner, neighborhood association, property owners within 250 ft., all addresses within 250 ft., all addresses on the subject property and any active and duly incorporated Homeowner's Association (HOA) involving the subject property. The recipients of the notice may submit written comments within the public comment period of 14 days after the date the notice is mailed.
Conformance review. Once a complete application is submitted, staff reviews the proposed plan to determine if it meets the criteria in SRC 701.
